Criminal Investigation in Germany of U.S. Officials for War Crimes in Abu Ghraib Torture
In a historic effort to hold high-ranking U.S. officials accountable for brutal acts of torture including the widely publicized abuses carried out at Abu Ghraib, on Tuesday November 30, 2004, the Center for Constitutional Rights (CCR) and four Iraqi citizens filed a criminal complaint with the German Federal Prosecutor’s Office at the Karlsruhe Court, Karlsruhe, Germany. Under the doctrine of universal jurisdiction, suspected war criminals may be prosecuted irrespective of where they are located.
The four Iraqis were victims of gruesome crimes including severe beatings, sleep and food deprivation, hooding and sexual abuse.
The U.S. officials charged include Secretary of Defense Donald Rumsfeld, Former CIA Director George Tenet, Undersecretary of Defense for Intelligence Dr. Stephen Cambone, Lieutenant General Ricardo Sanchez, Major General Walter Wojdakowski, Major General Geoffrey Miller, Brigadier General Janis L. Karpinski, Lieutenant Colonel Jerry L. Phillabaum, Colonel Thomas Pappas, and Lieutenant Colonel Stephen L. Jordan.
The criminal complaint was brought under the German Code of Crimes against International Law (CCIL) and seeks an investigation into war crimes allegedly carried out by high ranking United States civilian and military officials, including the incidents which occurred in Iraq.
The charges include violations of the German Code, “War Crimes against Persons,” which outlaws killing, torture, cruel and inhumane treatment, sexual coercion and forcible transfers. The Code makes criminally responsible those who carry out the above acts as well as those who induce, condone or order the acts. It also makes commanders liable, whether civilian or military, who fail to prevent their subordinates from committing such acts.
The German Code of Crimes against International Law grants German Courts what is called Universal Jurisdiction for the above-described crimes. Article 1, Part 1, Section 1 states: "This Act shall apply to all criminal offenses against international law designated under this Act, to serious criminal offences designated therein even when the offence was committed abroad and bears no relation to Germany.” This means that those who commit such crimes can be prosecuted wherever found: they, like pirates of old, are considered enemies of all humankind.
The German CCIL places a prosecuting duty on the German prosecutor for all crimes that constitute violations of the CCIL, irrespective of the location of the person, the crime, or the nationality of the persons involved. Complaints can be filed with the German prosecutor to seek an investigation of specific crimes, as was done here. While outside parties can bring complaints to the attention of a prosecutor in the U.S., there is no duty to prosecute such complaints and they do not become part of an official court procedure. In Germany, the prosecutor is under a duty to determine if an investigation and indictments are warranted; if he fails to do so, the complainants can appeal to the court.
There are no international courts or courts in Iraq that can carry out investigations and prosecutions of the U.S. role, either: the United States has refused to join the International Criminal Court, thereby foreclosing the option of pursuing a prosecution in international courts; Iraq has no authority to prosecute; and the U.S. gave immunity to all its personnel in Iraq from Iraqi prosecution.

Every gay down in Gayville liked gay marriage a lot...
But the Grinch, who lived just east of Gayville, did NOT!!
The Grinch hated happy Gays! The whole Marriage season!
Now, please don't ask why. No one quite knows the reason.
It could be his head wasn't screwed on just right.
It could be, perhaps, his Florsheims were too tight.
But I think the most likely reason of all was
His heart and brain were two sizes too small.
"And they're buying their tuxes!" he snarled with a sneer,
"Tomorrow's the first Gay Wedding! It's practically here!"
Then he growled, with his Grinch fingers nervously
drumming,
"I MUST find some way to stop Gay Marriage from coming!"
For, tomorrow, he knew... All the Gay girls and boys
would wake bright and early. They'd rush for their vows!
And then! Oh, the Joys! Oh, the Joys!
And THEN they'd do something he liked least of all!
Every Gay down in Gayville the tall and the small,
would stand close together, all happy and blissing.
They'd stand hand-in-hand. And the Gays would start
kissing!
I MUST stop Gay Marriage from coming! ...But HOW?"
Then he got an idea! An awful idea!
THE GRINCH GOT A WONDERFUL, AWFUL IDEA!
"I know what to do!" The Grinch laughed in his throat.
And he went to his closet, grabbed his sheet and his hood.
And he chuckled, and clucked, with a great Grinchy word!
"With this beard and this cross, I look just like our
Lord!"
"All I need is a Scripture..." The Grinch looked around.
But, true Scripture is scarce, there was none to be found.
Did that stop the old Grinch...? No! The Grinch simply
said,
"With no Scripture on Marriage, I'll fake one instead!"
"It's one man and one woman," the Grinch falsely said.
Then he broke in the courthouse. A rather tight pinch.
But, if Georgie could do it, then so could the Grinch.
The little Gay benefits hung in a row.
"These bennies," he grinned, "are the first things to go!"
Then he slithered and slunk, with a smile most uncanny,
around the whole room, and he took every benny!
Health care for partners! Doctors for kiddies!
Tax rights! Adoptions! Pensions and Wills!
And he stuffed them in bags. Then the Grinch, with a chill,
Stuffed all the bags, one by one, in his bill.
Then he slunk to the kitchen, and stole Wedding Cake.
He cleaned out that icebox and made it look straight.
He took the Gay-bar keys! He took the Gay Flag.
Why, that Grinch even took their last Gay birdseed bag!
And NOW!" grinned the Grinch, "I will pocket their Rings."
And the Grinch grabbed the Rings, and he started to shove
when he heard a small sound like the coo of a dove.
He turned around fast, and off flew his hood.
Little Lisa-Bi Gay behind him sadly stood.
The Grinch had been caught by small Lisa-Bi.
She stared at the Grinch and said, "My, oh, my, why?"
"Why are you taking our Wedding Rings? WHY?"
But, you know, that old Grinch was so smart and so slick
He thought up a lie, and he thought it up quick!
"Why, my sweet little tot," the fake Shepherd sneered,
"The judges are evil, the other states weird."
"I'll fix the rings there and I'll bring them back here."
It was quarter past dawn... All the Gays, still a-bed,
all the Gays still a-snooze when he packed up and fled.
"Pooh-Pooh to the Gays!" he was grinch-ish-ly humming.
"They're finding out now no Gay Marriage is coming!"
"Their mouths will hang open a minute or two
then the Gays down in Gayville will all cry Boo-Hoo!"
He stared down at Gayville! The Grinch popped his eyes!
Then he shook! What he saw was a shocking surprise!
Every Gay down in Gayville, the tall and the small,
was kissing! Without any bennies at all!
He HADN'T stopped Marriage from coming! IT CAME!
Somehow or other, it came just the same!
And the Grinch, with his grinch-feet ice-cold in the snow,
stood puzzling and puzzling: "How could it be so?"
"It came without lawyers, no papers to sort!"
"It came without licenses, came without courts!"
And he puzzled three hours, till his puzzler was sore.
Then the Grinch thought of something he hadn't before!
"Maybe Marriage," he thought, "doesn't come from the court.
Maybe Marriage...perhaps... comes right from the heart.
Maybe Marriage comes from all the words the Gays say.
Words like Husband, like Wedding, and Spouse who is Gay."
And what happened then...? Well...in Gayville they say
that the Grinch's small brain grew three sizes that day!
And the Gays had their Weddings. They promised for life.
They swore to be faithful, to Wife and her Wife.
The Husbands were happy, to each other they vowed
To be Out and be Honest, be Gay and be Proud.
They told all their neighbors and friends of their Spouse,
They told of their Marriage and sharing their house.
They said "We got Married." They shouted it loud.
Their marital status was "Married and Proud."
And the minute his heart didn't feel quite so tight,
He whizzed with his load through the bright morning light.
And he brought back the rings, cake and Gay birdseed bags!
And he... ...HE HIMSELF... hung the Gay Rainbow Flag!
"The Lord looked down, at the proud and the tall,
and said "These are my children, and I love them all."

(Cleveland, Ohio) CBS and NBC are refusing to run television commercials for the United Church of Christ calling the ads "too controversial".
As reported first by 365Gay.com, the 30 second commercials are aimed at attracting gays and others who feel alienated by other denominations. (story)
The 30-second commercial features two muscle-bound "bouncers" standing guard outside a picturesque church and selecting which persons are permitted to attend Sunday services. Written text interrupts the scene, announcing, "Jesus didn't turn people away. Neither do we." A narrator then proclaims the United Church of Christ's commitment that: "No matter who you are, or where you are on life's journey, you are welcome here."
MCC says that on Tuesday, CBS, NBC told the Church that the ads, which say "like Jesus -- the United Church of Christ (UCC) seeks to welcome all people, regardless of ability, age, race, economic circumstance or sexual orientation," imply the acceptance of gay and lesbian couples and therefore violate network standards.
"Because this commercial touches on the exclusion of gay couples and other minority groups by other individuals and organizations," reads an explanation from CBS, "and the fact the Executive Branch has recently proposed a Constitutional Amendment to define marriage as a union between a man and a woman, this spot is unacceptable for broadcast on the [CBS and UPN] networks."
Similarly, a rejection by NBC declared the spot "too controversial."
"It's ironic that after a political season awash in commercials based on fear and deception by both parties seen on all the major networks, an ad with a message of welcome and inclusion would be deemed too controversial," said the Rev. John H. Thomas, the UCC's general minister and president.
"What's going on here?"
The ads had been scheduled to run from today until Dec. 26.
The ad has been accepted and will air on a number of networks, including ABC Family, AMC, BET, Discovery, Fox, Hallmark, History, Nick@Nite, TBS, TNT, Travel and TV Land, among others.
"We find it disturbing that the networks in question seem to have no problem exploiting gay persons through mindless comedies or titillating dramas, but when it comes to a church's loving welcome of committed gay couples, that's where they draw the line," says the Rev. Robert Chase, director of the UCC's communication ministry.
CBS and NBC's refusal to air the ad "recalls the censorship of the 1950s and 1960s, when television station WLBT in Jackson, Miss., refused to show people of color on TV," says Ron Buford, coordinator for the United Church of Christ identity campaign. Buford, of African-American heritage, says, "In the 1960s, the issue was the mixing of the races. Today, the issue appears to be sexual orientation. In both cases, it's about exclusion."
The UCC has a long reputation for welcoming gays and lesbians. Although its individual churches are mostly autonomous, many offer blessing services for same-sex couples. In 1972 it became the first mainstream denomination to ordain an openly gay man.

So they are basically saying that showing any positive view of gays is wrong because of Bush and the FMA, and because it would be "controversial" to say that gays are nice people and many of them are in relationships. I guess it's not "controversial" to peddle the same pathetic stereotypes that we see endlessly on Queer Eye or Will & Grace or Project Runway.

So they are basically saying that showing any positive view of gays is wrong because of Bush and the FMA, and because it would be "controversial" to say that gays are nice people and many of them are in relationships. I guess it's not "controversial" to peddle the same pathetic stereotypes that we see endlessly on Queer Eye or Will & Grace or Project Runway.

Gay book ban goal of state lawmaker

MONTGOMERY - An Alabama lawmaker who sought to ban gay marriages now wants to ban novels with gay characters from public libraries, including university libraries.
A bill by Rep. Gerald Allen, R-Cottondale, would prohibit the use of public funds for "the purchase of textbooks or library materials that recognize or promote homosexuality as an acceptable lifestyle." Allen said he filed the bill to protect children from the "homosexual agenda."
"Our culture, how we know it today, is under attack from every angle," Allen said in a press conference Tuesday.
Allen said that if his bill passes, novels with gay protagonists and college textbooks that suggest homosexuality is natural would have to be removed from library shelves and destroyed.
"I guess we dig a big hole and dump them in and bury them," he said.
A spokesman for the Montgomery-based Southern Poverty Law Center called the bill censorship.
"It sounds like Nazi book burning to me," said SPLC spokesman Mark Potok.
Allen pre-filed his bill in advance of the 2005 legislative session, which begins Feb. 1.
If the bill became law, public school textbooks could not present homosexuality as a genetic trait and public libraries couldn't offer books with gay or bisexual characters.
When asked about Tennessee Williams' southern classic "Cat On A Hot Tin Roof," Allen said the play probably couldn't be performed by university theater groups.
Allen said no state funds should be used to pay for materials that foster homosexuality. He said that would include nonfiction books that suggest homosexuality is acceptable and fiction novels with gay characters. While that would ban books like "Heather has Two Mommies," it could also include classic and popular novels with gay characters such as "The Color Purple," "The Picture of Dorian Gray" and "Brideshead Revisted."
The bill also would ban materials that recognize or promote a lifestyle or actions prohibited by the sodomy and sexual misconduct laws of Alabama. Allen said that meant books with heterosexual couples committing those acts likely would be banned, too.
His bill also would prohibit a teacher from handing out materials or bringing in a classroom speaker who suggested homosexuality was OK, he said.
Allen has sponsored legislation to make a gay marriage ban part of the Alabama Constitution, but it was not approved by the Legislature.
Ken Baker, a board member of Equality Alabama, a gay rights organization, said Allen was "attempting to become the George Wallace of homosexuality."
Aside from the moral debates, the bill could be problematic for library collections, said Jaunita Owes, director of the Montgomery City-County Library, which is a few blocks from the Alabama Capitol.
"Half the books in the library could end up being banned. It's all based on how one interprets the material," Owes said.
